Entering both the European and American medical device markets requires navigating two distinct regulatory philosophies. The EU's Medical Device Regulation (MDR) is built on demonstrating conformity with General Safety and Performance Requirements (GSPR), a risk-based approach. Your technical documentation must prove your device is safe and performs as intended. In contrast, the US Food and Drug Administration (FDA) often relies on the 510(k) pathway, which is based on proving "Substantial Equivalence" to a legally marketed predicate device. While GSPR focuses on intrinsic safety and performance, the 510(k) is a comparative analysis.

Despite these differences, treating them as separate projects is inefficient. A successful dual-market strategy involves building a single, robust technical file that can be adapted for each market. This begins with understanding how your existing German and international standards (DIN/ISO) map to the expectations of both the EU's Notified Bodies and the FDA.

The core of this strategy is not to do the work twice, but to structure your core documentation—especially around quality and risk—to satisfy the stricter elements of both systems from the start.

Unifying Quality Systems

Your quality management system (QMS) is the foundation of your regulatory compliance. For German and EU manufacturers, ISO 13485 is the harmonised standard. The good news is that it aligns closely with the FDA's Quality System Regulation (QSR), found in 21 CFR Part 820. Both systems are based on principles of process control, documentation, and corrective/preventive actions. However, the FDA's QSR is law, not a standard, and its terminology and emphasis can differ.

For instance, the FDA's Design Controls (21 CFR 820.30) are notoriously prescriptive, requiring a detailed Design History File (DHF). While ISO 13485 also requires design and development planning, the FDA's expectations for documentation are often more rigorous. Similarly, the FDA has very specific requirements for Complaint Handling (21 CFR 820.198). The key is to build your QMS on your existing ISO 13485 framework and then add specific procedures and documentation practices to address the gaps with the QSR.

By maintaining a single, comprehensive risk management file (RMF) that is compliant with ISO 14971, you satisfy a core requirement for both markets simultaneously. This file should be a living document, updated throughout the device lifecycle.

Key Personnel and Representation

Navigating two markets also means appointing specific representatives for each. The EU MDR mandates that manufacturers have a (PRRC) available. This individual is legally responsible for overseeing key aspects of your regulatory compliance within the EU.

For the US market, foreign manufacturers must appoint a US Agent. The US Agent's role is primarily for communication. They are the initial point of contact for the FDA, assisting with correspondence and scheduling inspections. Unlike the PRRC, the US Agent is not required to have specific technical expertise and does not bear legal responsibility for the device's compliance. They are your official correspondent on US soil.

Sequencing Your Market Entry

The question of which market to enter first—EU or US—is a strategic one with no single right answer. The decision depends on your device classification, clinical data, and overall business strategy.

EU First: Leveraging an existing ISO 13485 certified QMS can make the EU a natural starting point. The technical documentation prepared for the CE Mark provides a very strong foundation for a subsequent FDA 510(k) submission. However, timelines for Notified Body review can be long and unpredictable.

US First: For some devices, the 510(k) pathway can be faster and less expensive than the EU MDR process, especially if a clear predicate device exists. This can lead to quicker revenue. The drawback is that you may need to perform additional work, especially around clinical evaluation and GSPR compliance, when you later decide to enter the EU.
